Publisher Policy

Nexxen’s Publisher Policy (“Policy”) outlines the guidelines and requirements for publishers using its supply-side platform and services. Key provisions cover media placement, content standards, fraud prevention, ad refresh, onboarding, industry compliance, enforcement, and third-party responsibilities. As a publisher (referred to as “Publisher”  or “You“), You are required to adhere to this Policy when using the Nexxen digital advertising supply-side services (the “Nexxen Supply Services“)  including individual publishers, app aggregators, and supply-side platforms (SSPs) — are required to adhere to this Policy when using the platform to monetize(“Publisher Inventory“). Advertising Inventory may include websites, mobile applications, CTV applications, applications managed by aggregators, other reseller models, and other digital media properties accessible through the Nexxen Services (collectively referred to as the “Publisher Properties“). This Policy applies to individual publishers, app aggregators, and supply-side platforms (SSPs) that integrate with Nexxen.

By participating in the Nexxen Supply Services, You agree to comply with (i) this Policy and any updates or changes made by Nexxen, (ii) the terms of the Publisher Agreement between You and Nexxen, and (iii)  all applicable laws and regulations in performing your role as a publisher. Failure to adhere to this Policy may result in the suspension of monetization of your inventory sources and/or termination of your account.

1. Media Placement

Publishers must adhere to the requirements below and are responsible for ensuring that all content on the Publisher Properties) complies with this Policy, including any Publisher Properties managed on behalf of third parties:

  • No more than three media units may be viewable at one time on each page.
  • No placements may be displayed in a pop-up, pop-under, or in an email.
  • No elements on the page may obscure any portion of the placements or redirect users to unwanted sites, modify browser settings, or otherwise adversely interfere with user navigation.
  • No placements on non-content-based pages, applications, or pages of sites that do not match the domains that were approved and vetted by Nexxen for the Publisher, or pages of sites that have been disapproved or rejected by Nexxen.
  • No placements on undeveloped or dead properties.
  • No placements on properties where substantial portions are gated behind a login, paywall, or subscription, unless such access is typical for the content type and pre-approved by Nexxen with test access provided.
  • No placement on properties that have no clear attribution of ownership or operation. No placements on properties that lack clear attribution of ownership or operation. Publisher Properties must provide end users with a transparent and accessible method to contact the owner or operator.

2. Other Restrictions

  • No media units may be triggered by or otherwise integrated into any adware, toolbars, add-ons, browser plug-ins, or similar software applications.
  • Publisher’s inventory specifications and criteria provided by Publisher to Nexxen must be true and accurate.
  • Neither the Nexxen Media Player nor any Nexxen-supplied video content may be altered. Nexxen-supplied code must be pasted directly into web pages without modification and without changing in any manner the behaviour, targeting, or delivery of the placements.
  • Publisher shall not strip, remove, or otherwise interfere with third party tags or wrappers implemented by Nexxen or its partners.
  • Publisher assumes responsibility for ensuring, at its own expense, that Publisher Properties operate the Nexxen Media Player compatibly and that any and all Nexxen-supplied video content display correctly. Nexxen has no obligation to notify Publisher even if it should become aware that Nexxen-supplied video content is not being displayed properly to end users of Publisher Properties.
  • Content must not include fraud, deceptive or manipulative behavior (including but not limited to deepfakes, audience inflation, malicious third-party links, or malicious code)
  • If Publisher Properties contain original financial or health-related content, appropriate disclaimers must be included in accordance with applicable legal and platform standards
  • All mobile applications must be listed in official app stores and CTV apps must be approved by platform operators. App Aggregators must submit complete app portfolios and attest to compliance for each asset.
  • For audio-based advertising inventory (i.e., podcasts), Publisher Properties distributed via third-party platforms (e.g., Apple, Spotify) must comply with applicable content policies of those platforms
  • Publisher Properties must contain a minimum of original content and may not be “Made-for-Advertising” (MFA) properties, defined as sites or apps that:
    • Contain content that offers little to no value;
    • Contain content taken from other sites without clear attribution or in violation of the law or of any third party’s rights;
    • Have content which is predominantly ads with little substantive content or are designed primarily to display ads; or
    • Are generated by artificial intelligence (AI) and are populated with synthesized or plagiarized content with falsified attributions of ownership.

3. Prohibited Content

Publisher Properties may not display or include any of the following types of prohibited content:

  • Promotion or sale of firearms, ammunition, bombs, other weapons, or related design materials, including handgun safety certificates, combat knives, stun guns, and BB guns
  • Pornography, nudity, adult or mature content, sexually explicit or suggestive content
  • Adult-themed dating or escort services, “mail-order brides,” or similar services
  • Anime or manga containing unlicensed, pirated, or adult content. Legitimate licensed content is permitted
  • Depictions, glorifications, or descriptions of violence, pain, suffering, torture, or death of or against humans or animals
  • Incitement of hatred or discrimination of any race, religion, creed, class, gender, sexual orientation, ethnic group, any individual, group or protected class
  • Promotion or use of illegal drugs, drug paraphernalia, or ways to pass a drug test
  • Sale or promotion of smoking tobacco, cigars, cigarette papers, or blunt wraps
  • Cult or occult-related content
  • Contains excessive profanity
  • Promotion or sale of alcohol-related products or content without regional legal compliance, age restrictions, and Nexxen approval
  • Promotion or facilitation of gambling, betting, or lottery content without regional licensing and Nexxen approval
  • Defamatory, libelous, abusive, harassing, offensive or obscene
  • Unmoderated or a significant amount of User Generated Content (UGC)
  • Infringement of intellectual property rights, including:
    • Sales or promotion of products that are replicas or imitations of designer goods
    • Sales or distribution of term papers or student essays
    • Promotion of illegal or person-to-person file-sharing, torrent, or other methods that facilitate or promote intellectual property infringement
  • Fraudulent content that:
    • Installs spyware, trojans, viruses or other malware
    • Sends a SMS message, or initiates a charge without explicitly notifying a user and requiring a tap or other intentional action (click-to-call or click-to-SMS ads must clearly indicate that clicking the ad will initiate the call or SMS message; conventions such as a phone number that looks like a hyperlink are acceptable forms of notification)
    • Claims a third-party plug-in, such as a Flash or Java player is outdated in order to entice users to download software
    • Promotes hacking, cracking or warez
    • Is misleading or contain content that is not reflective of what the user will find on the clickthrough URL
    • Employs phishing techniques that seek to trick the user into providing sensitive information by misrepresenting the identity of advertiser
    • Falsifies user interactions, such as faking clicks
    • Mimics system errors or messages
  • Misinformation, disinformation, or propaganda related to politics, health, science, or public safety, as determined by Nexxen
  • Any other content that is illegal, promotes illegal activities, products or services, promotes harmful activity, or otherwise infringes on the rights of others.

4. Invalid and Fraudulent Traffic

Publisher shall not use, and shall not permit the use of, any mechanical, computerized, fraudulent, deceptive, or any other invalid or artificial means of increasing viewership, engagement, impressions, usage or any other measure of Internet traffic, directly or indirectly, at any of Publisher Properties (individually and collectively, “User Engagements“).

Prohibited means and methods included but not limited to the following:

  • Bot(s), robot(s) malware, automated view- or engagement-generating tools or similar programs;
  • Third-party services that generate views or engagements through repeated manual clicks or automated means, such as paid-to-view or paid-to-surf services;
  • Placeholders or transparently-rendered placements (as opposed to fully visible placements able to attract organic user interaction);
  • Masking or cloaking a Publisher Property’s URL or using any other means to obscure the true source of traffic;
  • Automated query tools, computer generated search requests, inappropriate link baiting or buzz baiting, or similar improper or disreputable search engine optimization services or traffic purchased to drive traffic to pages displaying placements;
  • Auto-spawning of browsers, automatic redirecting of visitors, blind text links, misleading links, forced clicks (e.g., when a user is ‘forced’ to click because of a hijacked browser, or because a placement has been altered so that it is impossible to close without clicking it);
  • Toolbars, adware or similar applications that generate User Engagement by triggering pop-ups, redirecting users to unwanted Web sites, modifying browser settings, or otherwise interfering with user navigation;
  • Spam or other unsolicited and illegal emails or similar communications;
  • Inappropriate newsgroup, comments, microblog or similar postings;
  • Purchase of keywords in a manner that infringes trademark rights in order to drive traffic to pages displaying placements;
  • Keyloggers and Monitoring;
  • Proxy Avoid and Anonymizers; and
  • Spyware and Adware.
 

Nexxen will, in its sole discretion, determine whether any device or technology operates in a manner that generates the kind of User Engagement sought by its advertising clients, and may disqualify any User Engagement generated by means or methods that it determines in its sole discretion to be invalid or prohibited. Where valid or organically generated User Engagements are co-mingled with views or engagements resulting from prohibited methods, whether or not intentionally, Nexxen may, in its sole discretion, determine that all such User Engagements and other views and engagements (i.e., both valid and invalid) will be disqualified. Nexxen reserves the right to utilize MRC accredited vendors in making such determinations regarding User Engagements. Publisher agrees to comply with all applicable IAB standards.

5. Auto Refresh

Publishers may load new ads only when (a) the end user navigates to a new page or screen; (b) the current page is substantially updated with new content and at least one (1) minute has passed since the last refresh; or (c) the ad unit has remained in view for at least thirty (30) seconds, as measured by an MRC-accredited verification company. In no event may a Publisher refresh an ad unit more than twenty (20) times per end user session (e.g. slideshows) or within less than thirty (30) seconds of a previous ad refresh.

6. Onboarding, Monitoring and Ongoing Review of Publisher Properties

Publisher hereby consents to Nexxen monitoring, recording, using, and disclosing information about any Publisher Properties to verify compliance with this Policy and any Agreement. Publisher must inform Nexxen of any new Publisher Properties it wishes to onboard. Nexxen will conduct an onboarding review of such Publisher Properties. Nexxen reserves the right to refuse participation to any Publisher and/or Publisher Properties at any time in its sole discretion. Even if Nexxen approves a Publisher Property, Nexxen may later terminate such participation if determined by Nexxen that Publisher has breached the Agreement. Nexxen may conduct periodic audits of approved Publisher Properties. Material changes in content or ownership must be reported to Nexxen within ten (10) business days.

7. Compliance with IAB TCF Gold Standard 2.2

In accordance with the IAB TCF Gold Standard 2.2, all Publishers are required to update their ads.txt and app-ads.txt files to include our specified entries. By entering into the Agreement, the Publisher agrees to:

  1. Add the specified entries to their ads.txt and app-ads.txt files to authorize our ad inventory.
  2. Ensure both the ads.txt and app-ads.txt files are accurately maintained and updated as necessary.
  3. Notify Nexxen promptly of any changes or issues related to their ads.txt or app-ads.txt files that may affect our ad inventory authorization.
  4. Ensure that Nexxen is listed within the ads.txt and app-ads.txt files of their downstream partners through a contractual requirement or Terms & Conditions. Failure to comply with these requirements may result in termination of our advertising partnership.
  5. if applicable, maintain accurate sellers.json entries and include Nexxen and its partners in the IAB SupplyChain Object in all bid requests

8. Enforcement and Termination

Failure to adhere or comply with this Policy may result in disqualification of any Publisher Properties, termination of the Publisher Agreement, and/or the withholding or cancellation of any amounts that otherwise might have been payable to Publisher. Nexxen reserves the right to suspend, disable or terminate any account at any time.

Enforcement measures may include warnings, suspensions, revenue holds, or permanent bans, depending on severity and recurrence.

9. Responsibility for Third Party Practices

Publisher is responsible for any activity originating from IP address(es) of the Publisher Properties or from any computers, servers, or cloud-based services owned, used or contracted by Publisher, or otherwise under the Publisher’s control. Publishers must contractually bind third-party partners (e.g., affiliates, sub-publishers, SDK providers) to comply with this Policy. Failure to control partner conduct may result in disqualification. It is Publisher’s responsibility to ensure that no advertising network, affiliates or other persons or entities engage in any prohibited means or methods in relation to any of Publisher Properties. Nexxen will have no obligation or liability to any Publisher (or any other person or entity) if views or engagements on Publisher Properties are invalidated, amounts owing or payable are withheld or cancelled, or Publisher’s account area is disabled by Nexxen or its affiliates as a result of such activities, even if discovered to have been caused by third parties.This Policy is incorporated into and will be part of the Agreement between the Publisher and Nexxen. Any capitalized terms not defined in this Policy will have the meaning as set forth in the Agreement.

Agreement” means all document signed or accepted by and between the Parties including but not limited to the following, as applicable:

  • Advertising Services Agreement including all Addendum(s) and Amendment(s); and
  • Nexxen IOs.

By following this Policy, you contribute to creating a safe, engaging, and transparent advertising ecosystem on the Nexxen platform. Failure to comply with these guidelines may lead to the suspension or termination of your account. Nexxen reserves the right to update or modify this Policy at any time, and it is your responsibility to stay informed about any changes.
